OCEANS MALL UMHLANGA STANDARD COMPETITION’S
  • 1. These are the standard terms and conditions for competitions conducted or promoted by or in association with Oceans Mall, Umhlanga.
  • 2. Your entry into the competition and/or your acceptance of a prize (in the event that you win a prize) constitutes your binding acceptance of the terms and conditions on behalf of yourself and any person with whom you may share a prize (in the event that you win a prize which is for you and one or more additional persons ("your partner").

    3. Competition Period

  • These terms and conditions are for our always on competitions.The successful entrants will be contacted within 7 working days of the entries closing.The duration of the competition may be shortened or extended at the discretion of the Organiser.
  • It is the responsibility of participants to ensure that your entry is received by us prior to the closure of the competition. Any entries which are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry.
  • Without limitation, we and our affiliates are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, web site or other device or medium), or any combination thereof, or any other technical or other problems.

    4. Eligibility

  • To be eligible to participate in this competition, the participant must:Be a legal resident of the Republic of South Africa.Be a natural person and not juristic entity, which juristic entity includes but is not limited to a business to Business (B2B) partner of the organiser, cross border partner or retail partner of the organiser. The entry must be completed in the participant’s name.
  • The participant will be required to provide all the correct information.
  • The organiser will not be held responsible for incorrect information supplied, and a contestant not being contacted due to this.In the event that an uploaded text does not conform to the organiser’s requirements, the participants must consider their entry unsuccessful.
  • Entrants will not receive any payment for taking part in the competition or taking part in any media format related to it.You may not win a prize if it is unlawful for us to supply such a prize to you.
  • If you do win such a prize, you will forfeit it.Entrants under the age of 18 must obtain permission from their parents or guardians before entering.The competition is not open to: Directors, members, partners, agents, employees, or consultants of Oceans Mall Umhlanga, or any supplier of goods or services in connection with a competition; and the spouse, life partner, business partner or associate, or the natural or adopted parent, child, or sibling, of any of the persons specified in above.

    5. Competition Entry
  • If you use a mobile phone for entry into the competition, the telephone calls/text messages you make will be charged at the prevailing rates, which may vary from time to time. "Free" minutes under a cell-phone contract do not apply.
  • Entries may be submitted in a written, audio or drawing format.It is your responsibility to ensure that your entry is received by us prior to the closure of the competition.Any entries which are not received by us prior to the closure of the competition will not be eligible to participate, regardless of the reason for the late entry.We and our affiliates are not responsible for any entries which are not received by us, whether timeously or at all, regardless of the cause thereof.Without limitation, we and our affiliates are not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer hardware or software failure or malfunction, traffic congestion (whether physical, or on the Internet, telephone lines or at any service provider, web site or other device or medium), or any combination thereof, or any other technical or other problems.We and our affiliates are not responsible for any injury or damage to your or any other person’s computer, mobile telephone or other device used by you to enter or obtain any materials related to the competition.It is your responsibility to ensure that any information which you provide to us is accurate, complete, and up to date.
  • Any costs or expenses which you may incur other than in respect of those items specifically included in a prize are for your own account.
  • Oceans Mall Umhlanga will not be responsible for any costs or expenses which you, or your partner (if applicable), incur during and for purposes of your entry into the competition and your acceptance and/or use of a prize.We do not make any representations or give any warranties, whether expressly or implicitly, as to a prize, and in particular, but without limitation, make no representations and give no warranty that your entry or participation in the competition will necessarily result in you winning a prize; a prize, or any aspect thereof, will meet your, or, if applicable, your partner’s, requirements, preferences, standards or expectations; or a prize, or any aspect thereof, will be satisfactory, punctual, free from defects, safe or reliable.
  • We and our affiliates will not be responsible for any harm, damage, loss or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.

    6. Winner Selection and Reward

  • Prizes are not transferable and may not be deferred, changed, or exchanged for cash or any other item or size.
  • You must possess whatever documents and permissions that may be required in order to accept and use a prize, including, as regards international travel, a valid passport and all necessary visa and travel documentation, which documents and permissions are responsibility to obtain at your own cost, and which documents and permissions must remain valid in such minimum form and for such minimum period after the prize date as may be required by the relevant authorities.
  • The winners will be notified by means of the contact details provided to us.
  • If we are, or a third-party supplier is, unable to contact a winner within 3 working days or if the winner is unable to collect the prize within a reasonable time, the winner will forfeit the prize and Oceans Mall Umhlanga reserves the right to re-draw a new winner under the same conditions.We may invite you to be present when the prize winners are determined or announced, to participate in any of our marketing activities, to appear in person in the electronic media and/or the print media, and/or to endorse, promote or advertise any of our goods or services, for which no fee, royalty or other compensation will be payable.You may decline such an invitation.
  • We may publish names of the participants and winners on any of our communication platforms.We may require you to provide us with such additional information and documentation as we may reasonably require processing, confirming, and facilitating your acceptance and/or use of a prize. If you refuse to provide us with the requested information or documentation, you will forfeit the prize.
  • All correspondence regarding the prize must be directed at the supplier of the prize. Oceans Mall Umhlanga will not be responsible for any further correspondence, harm, damage, loss, or claim relating to the provision of any element of the prize.
  • We and our third-party suppliers reserve the right to vary, postpone, suspend, or cancel the competition and any prizes, or any aspect thereof, without notice at any time, for any reason which we deem necessary.
  • In the event of such variation, postponement, suspension or cancellation, you agree to waive any rights, interests, and expectations that you may have in terms of this competition and acknowledge that you will have no recourse against us, our affiliates and third-party suppliers.You agree that your participation in the competition, and your acceptance and/or use of a prize, or any aspect thereof, is at your own risk. We and our affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by us or any of our affiliates in accordance with the terms and conditions.In the event of your death, your family, dependents, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you, or your partner (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, whether

  • For purposes hereof, "affiliate" means our partners, co-promoters and sponsors of this competition, our subsidiaries, our and their subsidiaries and respective holding companies, the subsidiaries of their holding companies, and our and their directors, officers, employees, agents, and representatives.These terms and conditions will be construed, interpreted, and enforced in accordance with the laws of contract and dispute resolution in the Republic of South Africa.The winners will be notified by means of the contact details provided to us.
  • If we are, or a third-party supplier is, unable to contact a winner within 3 days or if the winner is unable to collect the prize within 10 days, the winner will forfeit the prize and Oceans Mall Umhlanga reserves the right to choose another winner.
  • Should the competition be run on a social media platform such as Instagram or Facebook, then the following rules will apply:The entrant releases the social media platform from any liability in any respect.
  • Entrants may not inaccurately tag content, and such inaccurate tagging shall result in disqualification.
  • The entrants and Oceans Mall Umhlanga acknowledges that the competition is in no way sponsored, endorsed, or administered by, or associated with, the social media platform.
  • The entrants and Oceans Mall Umhlanga acknowledge that they use the social media platform at their own risk.
  • The entrant may not use multiple accounts, and anyone found to use multiple accounts to enter will be disqualified.

    8. Data Privacy/Security:

  • Oceans Mall Umhlanga and the competition sponsor(s) will be considered co-responsible parties (co-controllers) in terms of POPIA. Personal Information will not be shared with any third party and will only be used to fulfill requirements of the competition and marketing by both parties, subject to your data subject rights as set out in our Privacy Notice on our website.Information will only be kept as stated in the Privacy Notice (for Oceans Mall Umhlanga), visit the sponsor’s website for more information regarding their information practices.
  • If you use a mobile phone or any other personal device for entry into the competition, the telephone calls / text messages / data you use will be charged at the prevailing rates, which may vary from time to time.     9. Limitation of Liability

    To the extent permitted by Consumer Protection Act and any other applicable law:The Participant and/or winner(s) hereby indemnifies the Organiser against any direct, indirect, special, incidental, consequential, or punitive damages or loss of any kind regardless of how this was caused, and whether it arose under the law of contract or delict or otherwise, because of the Participants entrance into the Competition.We and our affiliates will not be responsible, and disclaim all liability, for any loss, liability, injury, expense or damage (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, which is suffered by your participation in the competition or the acceptance and/or use by you, or your partner (if applicable), of any prize, or by any action taken by us or any of our affiliates in accordance with the terms and conditions.You, and in the event of your death, your family, dependants, heirs, assignees or any other beneficiaries of your estate, indemnify and hold us and our affiliates harmless against any claim by you, or your partner (if applicable), (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any injury, loss, liability, expense and/or damage which you may suffer, howsoever arising, in relation to your entry into this competition and/or acceptance and/or use by you of a prize.

    You acknowledge that the acceptance and use of a prize is subject to the provision that:
  • All of the terms and conditions will apply to both you and your partner (if applicable), and you will ensure that your partner agrees to be bound and complies, and will continue to comply, therewith.
  • You will take full responsibility for your partner.
  • You indemnify and hold us and our affiliates harmless against any claim by your partner or any third party in the event that your partner suffers any loss or damage pursuant to your partner’s acceptance and/or use of a prize.
  • Any minor will be accompanied by a parent or legal guardian.
  • If you fail or, if your partner (if applicable) fails, to comply with any of the terms and conditions, then without prejudice to any other remedy which we may have; -
    - You will be automatically disqualified, and you will forfeit the prize/s (in the event that you have already won a prize).
    - You will pay us for any loss or damage incurred by us directly or indirectly as a result of your (or, if applicable, your partner's) non-compliance, including all of our legal costs (including attorney and own client costs) which we may incur in taking any steps pursuant to your (or your partner’s) non-compliance.
    - You indemnify and hold us and our affiliates harmless against any claim by any person, (whether direct, indirect, incidental, punitive or consequential) of any nature, whether arising from negligence or any other cause, relating to any death, injury, loss and/or damage which may be suffered howsoever arising in relation to your failure (or that of your partner, if applicable) to comply therewith.
    - We and our affiliates will not be responsible for any harm, damage, loss, or claim relating to the provision of any element of a prize or any changes to a prize that may be made at any time.

    10. Counterfeit and Imitation Products Policy

    Oceans Mall reserves the right to immediately cancel any agreements, activations, promotions, or competitions with companies found to be selling, promoting, or exhibiting counterfeit or imitation products. Furthermore, Oceans Mall's competition terms and conditions shall always supersede competition rules and entries.
Oceans Mall User Generated Content (UGC) Submission
  • By submitting User Generated Content ("UGC") to Oceans Mall for the purpose of sharing on our social media platforms, you ("Submitter" or "Creator") agree to the following terms and conditions:

    1. Eligibility:
    - You must be at least 18 years old or have parental/guardian consent to participate.
    - By submitting UGC, you confirm that the content is your original work and does not infringe on any copyright, trademark, or other third-party rights.

    2. Content Ownership:
    - You retain ownership of your UGC, however, once UGC has been submitted to Oceans Mall, you grant Oceans Mall, its affiliates, and its partners a worldwide, royalty-free, non-exclusive license to use, share, repost, and promote your content on social media, marketing materials, and websites for promotional purposes.

    3. Selection of Content:

    - Oceans Mall reserves the right, at its sole discretion, to select which UGC will be featured on our social media channels, website, and other marketing platforms.
    - Not all submitted UGC will be selected for posting, and Oceans Mall has no obligation to feature any content submitted.

    4. Content Guidelines:
    - UGC must not include offensive, inappropriate, or harmful content, including but not limited to content that is discriminatory, offensive, defamatory, or violates the rights of others.
    - Oceans Mall reserves the right to reject any content that does not align with our brand values, image, or community guidelines.

    5. Credit & Acknowledgement:
    - Oceans Mall will credit the Creator by tagging their social media handle when sharing UGC, provided that the Creator’s handle is publicly available and clearly visible.
    - By submitting UGC, you agree to allow Oceans Mall to use your name, social media handle, and likeness in connection with the content.

    6. No Compensation:
    - Submission of UGC is voluntary, and there will be no monetary compensation or other for featured content. However, featured Creators may receive recognition through social media tags and mentions.

    7. Modification & Termination:

    - Oceans Mall reserves the right to remove any posted UGC at any time, for any reason, without notice.
    - These Terms & Conditions may be amended at any time without prior notice, and all submissions are subject to the terms in place at the time of submission.

    8. Indemnification:

    - You agree to indemnify and hold harmless Oceans Mall, its affiliates, and partners from any claims, damages, or losses arising out of your submission of UGC, including any breach of these Terms & Conditions or infringement of third-party rights.

    9. Governing Law:
    - These Terms & Conditions are governed by the laws of the South African Judicial System, and any disputes will be subject to the exclusive jurisdiction of the courts in that jurisdiction.
Gift cards Terms and Conditions
  • Gift cards can be purchased for any amount between R50 and R5000 
  • Gift Cards cannot be refunded or exchanged for cash or credit
  • ⁠Gift Cards are Valid for three (3) years from the date of issue
  • Free Transactions & No Fees: No card fee or charges for purchases. It works like a debit card and is safer than cash.
  • Gift Cards cannot be reloadable. Any unused funds will be forfeited after expiry.
  • No refunds for remaining balance.
  • Once all funds have been used, please destroy the card.
  • Gift Cards may be used to pay for goods and services wherever MasterCard is accepted in South Africa, and there will be a spillage fee of R25.00 per transaction if this Gift Card is not used at Oceans Mall Umhlanga.
  • Card Protection: Always sign your card. Safeguard it and report lost or stolen cards immediately at 086 110 1210.
  • You must sign a transaction slip for purchases. Keep track of your balance to avoid overspending.
  • You are responsible for the card's security. If lost or stolen, report immediately; were not liable for unauthorized use.
  • R25.00 will be charged for reissue of the Gift Card.
  • No interest earned on funds, and no refunds for unused balance after expiry.
  • You will not be charged any fees for the card or any purchases made using your card at Oceans Mall Umhlanga.
  • Balance enquiries can be done at the centre kiosk, using the USSD, https://www.whatsonmycard.com, or the support line 086 110 1210 between 9am and 6pm, seven days a week, including public holidays.

  • The Landlord and its agents will not be held liable for damage, loss, theft or copying of the gift card or for any malfunctions with respect to the in-store point of sales equipment.
  • The Landlord and its agents will not accept responsibility should any tenant decline the gift card as a form of payment or should the cardholder have any difficulties with the goods or services purchased with the gift card.
  • The amount registered on the cardholder’s gift card will not accrue any interest.
  • The gift card can’t be used for banking transactions and/or to pay other liabilities.
  • To the extent relevant, the purchase and use of this gift card is governed by the standard banking rules and regulations and shall be deemed to be incorporated herein by reference.
  • Exchange and return of merchandise purchased in whole or in part with the gift card, will be governed by the procedures and policies of the merchant and the applicable law. At the time of any exchange or return, the cardholder must present both the merchandise receipt and the gift card.
  • The cardholder may, at any time, terminate this agreement by destroying thecard. The cardholder will be responsible for any transactions if the gift card is not destroyed correctly and is used.
  • The Landlord reserves it rights to limit the amount of gift cards that the cardholder may purchase at any given time.
  • The Landlord does not provide any warranties, insurance or any other promises not specifically set out in these terms and conditions.
  • The cardholder may not vary the terms and conditions as set out above.

Oceans Mall – Oceans Cash Dash Competition Terms and Conditions
  • 1. Promoter

    The promoter of this competition is Oceans Mall, located in Umhlanga, KwaZulu-Natal.

  • 2. Competition Overview

    The Oceans Cash Dash is a promotional competition held at Oceans Mall. By participating, entrants agree to abide by these Terms and Conditions.

  • 3. Competition Dates

    The competition is valid for two days only:
    26th July 2025 and 27th July 2025.

  • 4. Entry Requirements

    To qualify for entry:
    Participants must purchase an Oceans Mall Gift Card of any value on 26 or 27 July 2025.
    Upon purchase, participants will receive one opportunity to enter the Money Bubble Tent.
    Each Participant is only allowed to make one Gift Card Purchase, which entitles them to one entry.
    Each qualifying participant is allowed one turn only, lasting 30 seconds inside the tent.

  • 5. Game Mechanics

    The Money Bubble Tent will be filled with fake Oceans Mall-branded Monopoly money.
    Hidden among the fake notes is one Golden Oceans Mall Cash Note valued at $1000 (fake currency).
    The participant who successfully finds a Golden Oceans Mall $1000 note during their turn will win a R1000 Oceans Mall Gift Card.
    All fake notes, including the golden one, are non-negotiable, non-transferable, and hold no cash value.

  • 6. Prize Redemption Rules

    Only one Golden Note may be redeemed per participant.
    If a participant finds more than one Golden Note (whether by error or chance), only one prize will be awarded.
    Multiple entries or attempts by the same individual are not permitted.
    The R1000 Oceans Mall Gift Card must be collected on the same day as the winning attempt, with valid proof of identity and qualifying gift card purchase.

  • 7. Important Notices

    All Oceans Mall Monopoly money, including the Golden Note, is entirely fictional and cannot be exchanged for real currency.
    The competition is run in good faith. Any form of dishonesty, misrepresentation, or abuse of the competition rules will lead to immediate disqualification.
    Oceans Mall reserves the right to:
    Verify the identity and eligibility of participants.
    Withdraw or modify the competition at any time, without prior notice, due to unforeseen circumstances.

  • 8. Eligibility

    Open to South African residents aged 18 years or older.
    Employees of Oceans Mall, their immediate family members, and promotional partners are not eligible to participate.

  • 9. Liability

    Participation in the competition is at the entrant's own risk.
    Oceans Mall shall not be held liable for any injury, loss, or damage suffered during the competition.

  • 10. Acceptance

    By participating in the Oceans Cash Dash, entrants confirm that they have read, understood, and agreed to these Terms and Conditions.
Counterfeit and Imitation Products

Counterfeit and Imitation Products Policy
Oceans Mall reserves the right to immediately cancel any agreements, activations, promotions, or competitions with companies found to be selling, promoting, or exhibiting counterfeit or imitation products. Furthermore, Oceans Mall's competition terms and conditions shall always supersede competition rules and entries.
